1. Notice of Infringement

MindSparkStack respects intellectual-property rights and complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on the Service infringes your copyright, send a written notice to our Designated Agent that includes:

  • A physical or electronic signature of the copyright owner or authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the allegedly infringing material with enough detail to locate it (URL).
  • Your contact information (name, address, phone, email).
  • A statement that you have a good-faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the owner’s behalf.

3. Counter-Notice

If your content was removed and you believe the removal was a mistake or misidentification, send a counter-notice including:

  • Your physical or electronic signature.
  • Identification of the removed material and where it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief that the removal was a mistake or misidentification.
  • Your name, address, and phone, plus a statement consenting to the jurisdiction of the federal district court for your address (or, if outside the US, the District of Delaware).
  • A statement that you will accept service of process from the original notifier.

Upon receipt of a valid counter-notice, we will forward it to the original notifier. Unless they file a court action within 10–14 business days, we may restore the material.

4. Repeat Infringers

We terminate accounts of repeat infringers in appropriate circumstances.

5. False Notices

Knowingly false DMCA notices and counter-notices subject the sender to liability for damages, costs, and attorneys’ fees under 17 U.S.C. § 512(f).
