Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to anyone using MindSparkStack products (StackPatch), the website, the Discord community, and the public quickscan API. It is incorporated into the Terms of Service. Violations may result in throttling, suspension, or termination without refund, plus referral to law enforcement where appropriate.

1. Prohibited Conduct

  • Anything illegal under U.S. federal law or the law of your jurisdiction.
  • Harassment, threats, doxxing, hate speech, or sexualized content involving minors.
  • Unauthorized access, scanning, probing, or attempts to bypass authentication on systems you do not own.
  • Distributing malware, spyware, ransomware, or any code intended to damage systems.
  • Sending unsolicited bulk email or SMS using our identifiers; CAN-SPAM / TCPA / CASL violations.
  • Scraping, crawling, or automated bulk extraction beyond rate-limited public APIs.
  • Submitting StackPatch inventory data from servers you do not own or have explicit authorization to scan.
  • Misrepresenting your identity or affiliation.
  • Interfering with the Service’s availability (DoS, resource exhaustion).

2. StackPatch-Specific Rules

StackPatch ingests Linux server inventory (kernel, packages, Docker images, ports). You additionally agree not to:

  • Submit inventory data from servers you do not own or are not explicitly authorized to scan on behalf of the owner.
  • Use the public quickscan API as a general-purpose CVE-database lookup proxy at scale (rate limit: 30/hr per IP).
  • Use the audit-URL feature to publish security posture for systems other than the ones you operate.
  • Resell or rebrand the StackPatch alert pipeline as your own service without a reseller agreement.

You remain solely responsible for installing the recommended patches on your servers. We tell you the command; you run it. We do not operate as a managed-services provider.

3. Rate Limits & Fair Use

Subscription plans include published rate limits. Sustained use materially above plan limits may be throttled or upgraded. We reserve the right to enforce reasonable limits to protect Service availability.

4. Reporting Abuse

Report violations to abuse@mindsparkstack.com. Provide URLs, timestamps, and any supporting evidence. We respond within 72 hours.

5. Enforcement

We may, at our discretion, investigate violations and take action proportional to severity: warning, content removal, throttling, suspension, or termination. We may preserve and disclose information to law enforcement where legally required or where we believe disclosure is necessary to prevent imminent harm.
